General Terms and Conditions of Sale

1. Purpose
These General Terms and Conditions of Sale ("T&Cs") govern the sales of products or services provided by gojiberry.ai ("Seller") through its website (the "Site"). The Seller is a SASU with a capital of 1000 euros, registered with the Paris Trade and Companies Register under number 85109983800019, with its registered office at 17 RUE HENRY MONNIER 75009 PARIS, France. 2. Acceptance of Terms
By placing an order on the Site, the Buyer acknowledges having read and accepted these T&Cs. The Seller reserves the right to modify these T&Cs at any time; the applicable version is the one in effect at the time of the order.

3. Description of Services
The Seller provides AI-powered virtual assistants designed to support sales professionals by automating tasks such as lead generation, customer engagement, and data analysis. These services are delivered through a Software-as-a-Service (SaaS) model accessible via the Site.

4. User Obligations
4.1 Account Registration
To access the services, the Buyer must create an account by providing accurate and complete information. The Buyer is responsible for maintaining the confidentiality of their account credentials and for all activities that occur under their account.

4.2 Acceptable Use
The Buyer agrees not to:
- Use the services for unlawful purposes or in violation of applicable laws and regulations.
- Attempt to disrupt or interfere with the services' functionality or security.
- Reverse engineer, decompile, or disassemble any part of the services.
- Use the services to transmit or store harmful or illegal content.

5. Data Protection and Privacy
5.1 Data Collection and Use
The Seller collects and processes personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable data protection laws. The data collected may include:
- Contact information (e.g., name, email address).
- Payment details.
- Usage data for analytics and service improvement.
- Technical data such as cookies and IP addresses.
- Personal data is used solely for providing and improving the services and is not shared with third parties without the Buyer's consent, except as required by law.

5.2 Data Security
The Seller implements appropriate technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction.

5.3 Data Subject Rights

6. Intellectual Property
All intellectual property rights related to the services, including software, content, and trademarks, are owned by the Seller or its licensors. The Buyer is granted a non-exclusive, non-transferable license to use the services in accordance with these T&Cs.

7. Service Availability and Limitations
The Seller strives to ensure the availability and reliability of the services but does not guarantee uninterrupted or error-free operation. The services are provided "as is" without warranties of any kind, express or implied.

8. Limitation of Liability
To the extent permitted by law, the Seller shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the services, including but not limited to loss of revenue or data.

9. Right of Withdrawal
In accordance with Article L.221-28 of the French Consumer Code, the Buyer expressly waives their right of withdrawal once the digital service has been accessed or executed.

10. Refund Policy
Refunds are granted only in the following cases:
- Failure to deliver the service due to a technical fault.
- Unintentional duplicate billing.

11. Compliance with Applicable Laws
The Buyer agrees to use the services in compliance with all applicable laws and regulations, including data protection laws in the European Union and the United States.

12. Modifications to the Services
The Seller reserves the right to modify or discontinue the services at any time, with or without notice. The Buyer agrees that the Seller shall not be liable for any modification, suspension, or discontinuation of the services.

13. Governing Law and Dispute Resolution
These T&Cs are governed by French law. In the event of a dispute, the parties will seek an amicable resolution. Failing that, the dispute shall be submitted to the competent courts of Paris, France.
